{"id":6494,"date":"2010-06-09T17:23:12","date_gmt":"2010-06-09T22:23:12","guid":{"rendered":"http:\/\/brianjnoggle.com\/blog\/?p=6494"},"modified":"2010-06-09T17:23:25","modified_gmt":"2010-06-09T22:23:25","slug":"i-read-californias-future-in-its-past","status":"publish","type":"post","link":"https:\/\/brianjnoggle.com\/blog\/2010\/06\/09\/i-read-californias-future-in-its-past\/","title":{"rendered":"I Read California&#8217;s Future In Its Past"},"content":{"rendered":"<p>California voters approved an <a href=\"http:\/\/www.latimes.com\/news\/nationworld\/world\/la-me-california-election-props-20100610,0,5782114.story?track=rss&#038;utm_source=feedburner&#038;utm_medium=feed&#038;utm_campaign=Feed%3A+latimes%2Fmostviewed+%28L.A.+Times+-+Most+Viewed+Stories%29\" target=\"_blank\">open primary system yesterday<\/a>.<\/p>\n<p>Lots of people are gnashing their teeth about it (see <a href=\"http:\/\/ace.mu.nu\/archives\/302477.php\" target=\"_blank\">Ace<\/a> and <a href=\"http:\/\/www.bookwormroom.com\/2010\/06\/09\/unscrambling-eggs-is-hard-work\/\" target=\"_blank\">Bookworm<\/a>).<\/p>\n<p>I&#8217;d gnash a little more if a <a href=\"http:\/\/www.nytimes.com\/2000\/06\/27\/us\/supreme-court-freedom-association-court-strikes-down-california-primary-placing.html?scp=1&#038;sq=%22supreme%20court%22%20california%20democratic%20jones%20198%20association&#038;st=cse\" target=\"_blank\">similar initiative hadn&#8217;t already been struck down in California in 2006<\/a>.<\/p>\n<p>I&#8217;m no constitutional scholar, but what I read of the opinion in the settled case&#8211;that the blanket primary takes away the parties&#8217; right of association&#8211;doesn&#8217;t seem solved in the new proposition.  I don&#8217;t see any comparisons between the two laws, so I could be mistaken.  I wish someone would enlighten me how this could pass Constitutional muster.<\/p>\n<p>Or are the proponents hoping that a Supreme Court with a different makeup will rule differently in a couple of years?<\/p>\n","protected":false},"excerpt":{"rendered":"<p>California voters approved an open primary system yesterday.
