{"id":1852,"date":"2005-01-14T15:37:00","date_gmt":"2005-01-14T15:37:00","guid":{"rendered":"http:\/\/brianjnoggle.com\/blog\/?p=1852"},"modified":"2018-07-28T10:28:59","modified_gmt":"2018-07-28T15:28:59","slug":"1852","status":"publish","type":"post","link":"https:\/\/brianjnoggle.com\/blog\/2005\/01\/14\/1852\/","title":{"rendered":"The Problem with Preventing Crime"},"content":{"rendered":"<p>Does anyone see the paradox in this?  <a href=\"http:\/\/www.cnn.com\/2005\/US\/01\/13\/intoxicated.pilot.ap\/index.html\" target=\"_new\">Pilot arrested in cockpit after screener smells alcohol<\/a>:<\/p>\n<p>The charge:<\/p>\n<blockquote><p>An armed AirTran Airways pilot was charged with operating an aircraft under the influence after a federal screener at McCarran International Airport smelled alcohol, authorities said Thursday.<\/p><\/blockquote>\n<p>The problem:<\/p>\n<blockquote><p>&#8220;The captain neither took command of the aircraft nor was the aircraft operated in any manner,&#8221; the airline said.<\/p><\/blockquote>\n<p>Authorities, operating under the assertion of the precogs, have charged this fellow with a crime he was about to commit but had not yet committed.  He&#8217;s not charged with conspiracy.  He is being charged with the actus reus, friends, and if it sticks, it&#8217;s precedent.<\/p>\n<p>Keep that in mind the next time you&#8217;ve had a couple of beers and go to get something out of the cabin of your car.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Does anyone see the paradox in this?
