Augusta has been <a href=\"http:\/\/www.nypost.com\/news\/regionalnews\/2175.htm\" target=\"new\">charged with third degree assault<\/a>.<\/p>\n<p><a href=\"http:\/\/caselaw.lp.findlaw.com\/nycodes\/c82\/a27.html\" target=\"new\">FindLaw.Com<\/a> indicates that this is not yet a felony in New York:<\/p>\n<ul>S 120.00 Assault in the third degree.<\/p>\n<p>  A person is guilty of assault in the third degree when:<\/p>\n<ol>\n<li>With intent to cause physical injury to another person, he causes such injury to such person or to a third person; or\n<li>He recklessly causes physical injury to another person; or\n<li>With criminal negligence, he causes physical injury to another<br \/>\nperson by means of a deadly weapon or a dangerous instrument.<\/ol>\n<p>  Assault in the third degree is a class A misdemeanor.<\/ul>\n<p>Hopefully, an enlightened politico on his or her way up will soon recognize the danger thrown birdseed poses and will bump this up to a felony.<\/p>\n<p>I&#8217;m Brian J.
